Welcome to Wholesomeology.

These Terms of Service (“Terms”) govern your access to and use of the Wholesomeology website, online store, products, services, content, and related features (collectively, the “Services”).

Throughout these Terms, the words “Wholesomeology,” “we,” “us,” and “our” refer to Wholesomeology LLC.

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you.

By accessing our website, browsing our store, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website.

If you do not agree to these Terms, please do not use our Services or place an order.


1. ELIGIBILITY & USE OF OUR SERVICES

By using our Services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have authorized any minor dependents under your care to use the Services under your supervision.

You agree to use our Services only for lawful purposes and in accordance with these Terms.

You may not use our website or Services:

  • For any unlawful or fraudulent purpose

  • To violate any applicable law or regulation

  • To infringe upon our intellectual property or the rights of others

  • To interfere with the security or operation of our website

  • To transmit viruses, malware, or other harmful code

  • To collect personal information belonging to others without authorization

2. OUR PRODUCTS

Wholesomeology creates handmade spiritual, ritual, botanical, and intention-based products.

Because our products are handmade, no two pieces will be perfectly identical.

Natural variations in color, texture, shape, size, scent, wax appearance, botanicals, crystals, and other materials are normal characteristics of handmade products and should not be considered defects.

Product photographs are provided to give you a general representation of each item. Colors and appearance may vary depending on your screen, device, lighting, photography, natural materials, and the individual handmade piece you receive.

We reserve the right to modify product designs, ingredients, materials, packaging, colors, or descriptions when reasonably necessary.

We also reserve the right to discontinue products or limit quantities at any time.


3. HANDMADE PRODUCTION & PRE-ORDERS

Wholesomeology is a small, independently operated business. Products are handmade and may be produced specifically in response to customer orders.

When a product is offered as a PRE-ORDER, you are purchasing an item that may not yet be completed at the time your order is placed.

Estimated processing times are provided on the applicable product page and/or in our Shipping Policy.

Please understand that handmade production takes time.

Processing times are estimates and may be extended during periods of high demand, product launches, restocks, holidays, unexpected circumstances, or other events affecting our ability to produce orders.

We reserve the right to cap or temporarily close pre-orders when our production capacity has been reached.

By placing a pre-order, you acknowledge and agree to these production timelines.


4. ORDERS & ACCEPTANCE

When you place an order through our website, you are submitting an offer to purchase the products in your cart.

Receipt of an order confirmation does not necessarily mean that Wholesomeology has accepted your order.

We reserve the right to accept, refuse, limit, or cancel any order at our discretion, including orders that appear fraudulent, unauthorized, incorrectly priced, or inconsistent with these Terms.

If we cancel an order after payment has been received, we will issue an appropriate refund for the canceled portion of the order.

Please carefully review your order, shipping address, product selections, quantities, and other information before completing checkout.

Once an order enters production or fulfillment, we may be unable to accommodate cancellation requests.


5. PRICES & PAYMENT

All prices displayed on our website are subject to change without notice.

The price charged for an order will generally be the price displayed at the time the order is placed, except where an obvious pricing error has occurred.

Prices may not include applicable sales tax, shipping charges, or other fees unless specifically stated.

You agree to provide accurate and complete billing, payment, contact, and shipping information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel transactions that appear fraudulent, unauthorized, or otherwise suspicious.


6. SHIPPING & DELIVERY

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms.

Because Wholesomeology products are handmade, processing time and shipping transit time are separate.

Processing time is the time required for us to make and prepare your order. Shipping time begins after your order has been shipped.

Carrier delivery dates are estimates and are not guaranteed.

We are not responsible for delays caused by shipping carriers, weather, holidays, customs, incorrect addresses, natural disasters, or other circumstances outside our reasonable control.

7. RETURNS, REFUNDS & EXCHANGES

Returns, refunds, cancellations, and exchanges are governed by our Refund Policy, which is incorporated into these Terms.

Please review the Refund Policy before placing your order.

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws.


8. CANDLE & PRODUCT SAFETY

Wholesomeology candles are products that involve an open flame and must be used responsibly.

Always follow the candle safety instructions provided with your purchase.

Never leave a burning candle unattended.

Keep candles away from children, pets, flammable materials, drafts, and anything that could catch fire.

Place candles on a stable, heat-resistant surface and use appropriate candle holders or vessels when applicable.

Do not move a candle while it is burning or while the wax is hot.

Do not burn a candle beyond the recommended burn time or allow it to burn completely to the bottom of its container.

Natural waxes, botanicals, herbs, flowers, crystals, and other decorative materials may alter how a candle burns. Never assume that a candle is safe simply because it is made from natural materials.

Natural does not mean fireproof.

You are responsible for following all included safety instructions and using our products appropriately.

9. SPIRITUAL & RITUAL PRODUCTS

Wholesomeology products are created for spiritual, ritual, reflective, creative, and personal practices.

Any descriptions of intentions, symbolism, spiritual traditions, energetic properties, or ritual uses are provided for informational, spiritual, or entertainment purposes and represent the intended theme or purpose of the product.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Nothing on our website should be considered medical, psychological, legal, financial, or other professional advice.

Individual experiences with spiritual or ritual practices vary, and Wholesomeology does not guarantee any particular spiritual, emotional, energetic, financial, romantic, or other outcome from using our products.


10. ALLERGENS & NATURAL MATERIALS

Our products may contain or come into contact with natural waxes, botanicals, herbs, flowers, essential oils, fragrances, crystals, and other materials.

If you have allergies, sensitivities, or other concerns about a particular ingredient or material, please contact us before purchasing or using the product.

You are responsible for reviewing available product information and determining whether a product is appropriate for you, your household, or your environment.


11. INTELLECTUAL PROPERTY

All content associated with Wholesomeology, including but not limited to:

  • Names and logos

  • Product names and descriptions

  • Photographs

  • Graphics

  • Videos

  • Written content

  • Designs

  • Artwork

  • Website content

  • Branding

  • Original product concepts

  • Social media content

is owned by or licensed to Wholesomeology and is protected by applicable intellectual property laws.

You may view and use our website for personal, non-commercial purposes.

You may not reproduce, copy, modify, distribute, sell, publish, create derivative works from, or commercially exploit our content without our prior written permission.

This includes copying our original product concepts, descriptions, photography, branding, or other proprietary content for use in another business.

All rights not expressly granted are reserved.


12. USER REVIEWS, COMMENTS & SUBMISSIONS

If you submit a review, photograph, comment, testimonial, suggestion, idea, or other content to Wholesomeology (“User Content”), you represent that:

  • You have the right to submit the content

  • The content does not violate another person's rights

  • The content is not fraudulent or misleading

  • The content does not contain unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material

  • The content does not contain malicious software

By submitting User Content, you grant Wholesomeology a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, modify, and distribute that content in connection with our business and marketing.

For example, we may repost a customer review or photograph on our website or social media.

We are not required to publish or maintain any User Content and may remove content that we believe violates these Terms or is otherwise inappropriate.

14. SHOPIFY

Our online store is hosted on Shopify.

Shopify provides the technology and infrastructure that allows us to operate our online store, but purchases made through our website are transactions between you and Wholesomeology.

Shopify is not responsible for the products we sell, the fulfillment of our orders, or any issues arising from your purchase from Wholesomeology.

Your use of Shopify-powered portions of the website may also be subject to Shopify's applicable terms and policies.


15. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, our Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that:

  • Our website will always be available or uninterrupted

  • Our website will be error-free

  • Product availability will remain constant

  • Product descriptions will always be free from errors

  • Products will meet every individual's subjective expectations

  • Spiritual or ritual products will produce any particular result

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded or limited under applicable law.


16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Wholesomeology and its owners, employees, contractors, service providers, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our Services or products.

This includes, where legally permitted, loss of profits, loss of revenue, loss of data, business interruption, or other indirect losses.

To the fullest extent permitted by applicable law, our total liability arising from any claim relating to a product or Service will not exceed the amount you actually paid to Wholesomeology for the product or Service giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited, including liability that applicable law prohibits us from limiting.


17. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Wholesomeology LLC and its owners, employees, contractors, agents, service providers, affiliates, and licensors from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your violation of these Terms

  • Your unlawful use of our Services

  • Your violation of another person's rights

  • Your misuse of our products

  • Your User Content

  • Your violation of applicable laws or regulations

This provision does not require you to indemnify Wholesomeology for claims caused by Wholesomeology's own conduct to the extent such indemnification is prohibited by applicable law.

We may suspend or terminate your access to our Services if we reasonably believe you have violated these Terms or if necessary to protect our business, website, customers, or other users.

Termination will not affect obligations or rights that arose before termination.

These Terms shall be governed by and interpreted in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles, except to the extent applicable federal law or mandatory consumer protection laws provide otherwise.

Any dispute arising from these Terms or your use of our Services shall be brought in a court of competent jurisdiction as permitted by applicable law.

Your continued use of our website or Services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
